TERMS AND CONDITIONS (T&C)

 

1. INTRODUCTORY PROVISIONS

1.1. These Terms and Conditions (T&C) of ARTURE Art & Nature s.r.o. govern the mutual rights and obligations arising from purchase contracts concluded with customers having their delivery address outside the Czech Republic.

1.2. For customers within the European Union (EU), these T&C respect the mandatory consumer protection laws of the EU. For customers outside the EU (e.g., USA, Switzerland, UK), the relationship is governed primarily by these T&C and the Czech Civil Code.

 

2. PURCHASE CONTRACT AND ORDERING

2.1. The Buyer places an order by clicking the "BUY" button. By doing so, the Buyer acknowledges the obligation to pay for the order and confirms that they have read and agreed to these T&C.

2.2. Due to the international nature of the sale, the purchase contract is concluded only upon the Seller’s formal acceptance sent via e-mail.

 

3. PRICE AND PAYMENT TERMS

3.1. Prices are listed including VAT. For international shipping, the final price may be adjusted based on the destination country’s tax regulations (e.g., exports outside the EU).

3.2. Payment methods:

• Online payment via ComGate (credit/debit card, bank transfer)

• Standard Bank Transfer based on an invoice.

3.3. In the case of international bank transfers, the Buyer is responsible for any intermediary bank fees. 

 

4. INTERNATIONAL SHIPPING AND OVERSIZED GOODS

4.1. Standard shipments: Smaller items are shipped via GLS or other courier services. Shipping costs are displayed in the shopping cart.

4.2. Oversized and pallet shipments (e.g., furniture or larger quantities):

Due to the nature of the products (weight, dimensions, fragility), shipping for oversized items is handled individually.

If the shopping cart displays "Custom shipping quote required", the shipping price is not included in the initial total.

After receiving the order, the Seller will request a custom shipping quote from professional freight forwarders based on the destination and shipment parameters.

The Seller will send the shipping quote to the Buyer for approval. The purchase contract is concluded only after the Buyer confirms acceptance of the shipping price. If no agreement is reached, the order will be cancelled without any penalty.

4.3. Customs and taxes (non-EU deliveries):

For deliveries outside the European Union, the Buyer is responsible for all import duties, taxes, and customs clearance fees required by the destination country.

 

5. WITHDRAWAL FROM THE CONTRACT (EU Consumers only)

5.1. Consumers residing in the European Union have the right to withdraw from the contract within 14 days of receiving the goods without giving any reason.

5.2. Exceptions:

The right of withdrawal does not apply to goods made according to the Buyer’s specifications or clearly personalized (custom-made products).

5.3. To withdraw from the contract, the Buyer must inform the Seller via e-mail at: eshop@a-n.cz.

5.4. The Buyer bears the full cost of returning the goods to the Seller’s address:

For oversized items, the Buyer is responsible for arranging appropriate transport (e.g., pallet shipping).

5.5. The Seller will refund all payments received from the Buyer within 14 days from the withdrawal from the contract, using the same payment method, unless otherwise agreed.

 

6. DEFECTIVE PERFORMANCE AND WARRANTY

6.1. The Seller is liable to the Buyer that the goods are free from defects upon receipt and correspond to the agreed description.

6.2. Natural materials:

Due to the nature of ARTURE products (antlers, wood, metal, handmade production), minor variations in color, shade, grain, texture, or natural features are inherent characteristics and do not constitute a defect, provided that they do not affect the functionality or intended use of the product.

6.3. The Buyer is entitled to exercise rights from defects that occur within 24 months from receipt of the goods, unless a longer warranty period is specified for a particular product.

6.4. If a defect becomes apparent within 12 months of receipt, it is presumed that the defect existed at the time of delivery, unless the nature of the goods or the defect indicates otherwise.

6.5. Rights from defective performance:

In case of defective goods, the Buyer is entitled to:

• repair of the defect
• replacement of the goods
• a reasonable price reduction
• withdrawal from the contract (where applicable by law)

The choice of remedy depends on the nature of the defect and applicable legal regulations.

6.6. Inspection upon delivery:

The Buyer is strongly advised to inspect the shipment upon receipt. If the packaging is visibly damaged, the Buyer should refuse the shipment or record the damage with the carrier.

6.7. Complaint procedure:

The Buyer should notify the Seller of the defect without undue delay after discovering it and send a description of the defect, including photographic documentation, to: eshop@a-n.cz.

 

7. GOVERNING LAW AND DISPUTE RESOLUTION

7.1. These T&C and all legal relationships between the Seller and the Buyer are governed by the laws of the Czech Republic.

7.2. Out-of-court dispute resolution:

The Czech Trade Inspection Authority (www.coi.cz) is the designated body for out-of-court settlement of consumer disputes.

7.3. For online disputes within the European Union, the Buyer may also use the EU Online Dispute Resolution platform (ODR):

FINAL PROVISIONS

These Terms and Conditions form an integral part of the purchase contract.
